1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your access to and use of the website at prophuntllp.com (the "Website") and all real estate advisory services offered by PROPHUNT LLP ("we", "us", "our", or "PROPHUNT").

PROPHUNT LLP is a Limited Liability Partnership registered in India and a MahaRERA-registered real estate agent under the Real Estate (Regulation and Development) Act, 2016. MahaRERA Agent Registration No.: A52100037156.

By accessing or using our Website, submitting an enquiry, or engaging our services, you ("User", "you", or "your") agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website or services.

2. Nature of Services

2.1 What We Do

PROPHUNT LLP is a MahaRERA-registered real estate agent that facilitates transactions between property buyers and RERA-registered real estate developers/promoters. Our services include property discovery, shortlisting, site visit coordination, negotiation support, documentation guidance, home loan facilitation, and NRI property advisory.

2.2 What We Are Not

PROPHUNT LLP is:

• Not a developer, promoter, or builder of any real estate project
• Not a party to any Agreement for Sale between a buyer and a developer
• Not a legal firm; our documentation guidance is not a substitute for independent legal advice
• Not a financial institution; our home loan facilitation connects you with banks/NBFCs but we are not a lender
• Not a valuation firm; any price estimates we provide are indicative only

2.3 Authorised Agent Status

We operate as an authorised channel partner for the developers listed on our Website. Our services to buyers are provided at no direct cost to you "” we receive a commission from the developer upon successful transaction completion. This does not affect the official developer price you pay.

3. Use of the Website

3.1 Permitted Use

You may use our Website for lawful personal and commercial purposes related to property discovery and enquiry. You may not:

• Use the Website in any way that is unlawful, harmful, or fraudulent
• Attempt to gain unauthorised access to any part of the Website or its related systems
• Use automated tools (bots, scrapers, crawlers) to extract content from the Website without prior written permission
• Reproduce, republish, or distribute Website content (including property listings, images, or descriptions) without our written consent
• Submit false, misleading, or inaccurate information through any form on the Website
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

3.2 Website Availability

We aim to keep the Website available at all times but do not guarantee uninterrupted access. We reserve the right to suspend, withdraw, or restrict access to the Website for business or operational reasons, without notice.

4. Pricing and Information Disclaimer

• Prices marked with asterisk (*) (e.g., "Rs 1.2 Cr*") indicate indicative base prices and do not include GST, stamp duty, registration charges, PLC, floor rise, maintenance deposit, or other costs applicable at the time of booking.
• Carpet area, configurations, and amenities are as declared by the developer on MahaRERA and may differ from what is depicted in marketing materials.
• Project completion and possession dates are as declared by the developer; PROPHUNT LLP makes no representation regarding timely completion or delivery.
• RERA registration status of projects is verified at the time of listing but may change; buyers must independently verify current status on maharera.mahaonline.gov.in.
• Investment projections and rental yield estimates are illustrative only and not a guarantee of returns. Real estate investments are subject to market risks.

The developer's MahaRERA registration filing and the registered Agreement for Sale are the only legally binding sources of project information and commitments.

5. RERA Compliance

PROPHUNT LLP is registered as a real estate agent under Section 9 of the Real Estate (Regulation and Development) Act, 2016 with MahaRERA. Agent Registration No.: A52100037156.

In accordance with our obligations under RERA and MahaRERA Rules, 2017:

• We facilitate transactions only for projects registered under MahaRERA
• We do not collect booking amounts or advance payments on behalf of any developer
• We do not make representations that contradict the developer's MahaRERA filings
• We maintain records of all transactions facilitated as required by law
• We are subject to the grievance redressal mechanism of MahaRERA

6. Intellectual Property

All content on this Website "” including but not limited to text, design, graphics, logos, icons, images, audio clips, and software "” is the property of PROPHUNT LLP or its licensors and is protected by Indian and international intellectual property laws.

Project images, brochures, floor plans, and specifications displayed on this Website are the intellectual property of the respective developers and are used with permission for the purpose of marketing their projects. Reproduction without developer permission is prohibited.

The PROPHUNT LLP name, logo, and the tagline "भूमिं मृगयध्वम् | Hunt the Land" are trademarks of PROPHUNT LLP. Unauthorised use is strictly prohibited.

7. Limitation of Liability

To the fullest extent permitted by applicable law:

• PROPHUNT LLP shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Website or reliance on information contained therein.
• We are not liable for any losses arising from a developer's failure to deliver a project, any defect in the property, delays, or developer insolvency.
• We are not responsible for the accuracy of information provided by developers in their MahaRERA filings or marketing materials.
• Our maximum aggregate liability to any user arising out of or in connection with our services shall not exceed the service fees actually paid by you to PROPHUNT LLP for the specific service giving rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded under applicable law.

8. Indemnification

You agree to indemnify, defend, and hold harmless PROPHUNT LLP, its partners, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Website or services; (b) your breach of these Terms; (c) your violation of any third party's rights; or (d) any inaccurate information you submitted to us.

9. Third-Party Services and Links

Our Website contains links to developer websites, the MahaRERA portal, Google Maps, banking institutions, and other third-party services. These links are provided for informational convenience only. PROPHUNT LLP:

• Does not control, endorse, or accept responsibility for the content, privacy practices, or terms of any third-party website

10. Termination of Access

Disputes relating to RERA-regulated transactions may also be referred to MahaRERA under Sections 31"“40 of the Real Estate (Regulation and Development) Act, 2016.
